Distance Sales Agreement — Subscription Terms
Rights and obligations of the parties under Law No. 6502 and the Distance Contracts Regulation for subscription and digital service purchases.

Because the service is digital, withdrawal may be limited once performance has begun — read the relevant clauses carefully. For upgrades or invoices, email support with the date and plan name.
The agreement is prepared under distance-sales rules. Updates are published on this page. Terms of service and privacy are complementary documents.
Plan name, price, and billing period shown at checkout are binding. Promotional prices apply only while displayed; renewals may follow the standard price afterward.

Parties
This distance sales agreement is formed between the seller and the buyer who purchases a subscription or digital service electronically. Buyer details come from membership and/or order records.
If the buyer acts for a company, the person completing checkout represents that they are authorized to bind that company. Invoices use the billing details supplied at purchase.

Subject of the agreement
The subject of this agreement is to set the parties’ rights and obligations regarding digital services and products purchased electronically by the BUYER from the SELLER via atalay.ai, the odeme.atalay.ai payment area, and/or the mobile app, under Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.
Website Builder plans, subscription renewals, and related digital access rights fall within this scope. The agreement is deemed formed when the order is approved electronically.
Enterprise or custom development sold outside self-service checkout is not covered by this form agreement unless the order expressly says so; those engagements use a separate quote or contract.
Service information
The essential characteristics of the service are clearly disclosed to the BUYER on the order page. The service fee includes VAT. Payment is made by credit or debit card through the iyzico secure payment infrastructure.
Plan name, fee, billing period, and payment method are shown at checkout. Current plan contents also appear on the pricing page; details at the time of order are binding.
Promotional prices apply only while the promotion is displayed at checkout. After a promo ends, renewals follow the standard price unless another offer is shown.
General provisions
Acceptable-use and content rules in the terms of service also apply to accounts opened under this agreement. Misuse may lead to suspension without affecting amounts already due for periods used.
- The BUYER acknowledges having read and understood the essential characteristics, price, and payment method.
- The SELLER undertakes to deliver the service fully and in line with the stated characteristics.
- The SELLER may work with third-party providers to deliver the service.
- The BUYER must protect account credentials and use the service lawfully.
Delivery
Digital services are made available immediately or within 24 hours after payment confirmation. In force majeure cases this period may extend up to 72 hours.
Delivery is by electronic access. In case of technical faults or payment-provider delays, the SELLER will use reasonable efforts to restore or grant access.

Right of withdrawal
Provided the BUYER has not started using the service, the BUYER may withdraw within 14 days of purchase.
To withdraw, email destek@atalay.ai with your order details. For subscriptions already in use, end-of-period cancellation options are considered instead of withdrawal.
Starting the website builder, generating a site, or publishing under the paid plan usually counts as beginning performance for withdrawal purposes.

The right of withdrawal cannot be used in the cases above.
Refunds
If the right of withdrawal is exercised, payment is refunded to the same payment method within 14 days.
Your bank may take extra time before funds appear. Declined requests include a reason by email.

Payment and security
Payments are processed via iyzico. The SELLER does not store card details. Transactions are encrypted with SSL and aligned with PCI DSS standards.
Suspicious transactions may require extra verification or be declined. Access may be temporarily restricted for security.
Failed payments may retry according to the payment provider; unresolved failures can pause renewals until a valid method is on file.
Disputes
Consumer Arbitration Committees and Consumer Courts have jurisdiction over disputes arising from this agreement.
We recommend seeking a resolution via support first. For non-consumer commercial purchases, generally competent courts may apply.
Keep order emails and invoices; they speed up both support and any formal complaint.
Entry into force
The BUYER declares having read, understood, and accepted this agreement. It enters into force on the date it is approved electronically.
